These Recording & Media Terms apply to individuals who submit a question through AskDoctorCliff.com and agree to participate in a recorded Ask Doctor Cliff conversation with Dr. Clifford R. Olson.
By checking the required consent box, electronically signing, and submitting your question, you acknowledge that you have read, understand, and agree to the following terms.
If your question is selected and you participate in an Ask Doctor Cliff video call, you knowingly and voluntarily consent to the audio and video recording of your conversation with Dr. Clifford R. Olson.
The recording may include your name, image, likeness, voice, questions, statements, opinions, personal experiences, and information or materials you voluntarily choose to share.
You authorize AskDoctorCliff.com, Dr. Clifford R. Olson, and their owners, producers, employees, contractors, representatives, licensees, successors, and assigns to record, reproduce, edit, excerpt, publish, display, distribute, broadcast, transmit, promote, and otherwise use your participation, in whole or in part.
Your participation may be used on or through:
Your recording may be used to create full-length videos, shorter videos, clips, social media posts, previews, compilations, advertisements, thumbnails, promotional materials, and other content.
You grant these media rights worldwide and without limitation as to duration, except where otherwise required by applicable law.
You understand that your recorded conversation may be edited for length, clarity, pacing, format, production quality, educational value, or other editorial purposes.
You will not have the right to inspect or approve the final video, edited clips, titles, thumbnails, captions, advertisements, promotional materials, or other content before publication unless AskDoctorCliff.com separately agrees otherwise in writing.
AskDoctorCliff.com will not intentionally edit your statements for the purpose of materially misrepresenting what you said.
Ask Doctor Cliff discusses hearing and hearing healthcare. During your conversation, you may voluntarily choose to disclose personal or health-related information, including information concerning your:
You authorize AskDoctorCliff.com and Dr. Olson to record, discuss, display, edit, reproduce, publish, and distribute health-related information that you voluntarily provide or disclose for purposes of participating in Ask Doctor Cliff.
You understand that publication may identify you as an individual who has or has experienced a particular hearing, medical, or health condition.
To the extent information covered by these terms constitutes Protected Health Information ("PHI") under HIPAA or another applicable health privacy law, you authorize its use and disclosure as follows:
Information authorized for use or disclosure: Health, medical, audiologic, hearing-related, and treatment information that you voluntarily submit, provide, display, or discuss for purposes of participating in Ask Doctor Cliff, including audiograms, hearing test results, records, photographs, screenshots, or other materials you specifically provide for discussion or use on the program.
Persons or organizations authorized to use or disclose the information: Dr. Clifford R. Olson, AskDoctorCliff.com, Applied Hearing Solutions to the extent applicable, and individuals or companies assisting with the production, editing, publication, promotion, or distribution of Ask Doctor Cliff.
Persons or organizations authorized to receive the information: AskDoctorCliff.com and its production partners, YouTube and other media and distribution platforms, and the general public.
Purpose of the use or disclosure: To produce, edit, publish, distribute, display, promote, advertise, and market Ask Doctor Cliff and related educational and media content.
Expiration: This authorization expires ten (10) years after the date you electronically sign these terms, except to the extent applicable law requires otherwise.
You understand that Ask Doctor Cliff content is intended for public distribution.
Health or personal information publicly disclosed pursuant to this authorization may no longer be protected by HIPAA or other privacy laws and may be redisclosed by the people or organizations who receive it.
Members of the public may view, copy, download, record, screenshot, share, repost, discuss, archive, or otherwise distribute publicly available content.
AskDoctorCliff.com cannot guarantee that information that has been publicly released can later be completely removed from the internet or recovered from third parties.
To the extent this authorization is governed by HIPAA or another applicable health privacy law, you may revoke your authorization regarding future uses or disclosures of protected health information by providing written notice to AskDoctorCliff.com.
Revocation will not affect uses or disclosures already made in reliance on your authorization before the revocation was received.
Revocation also cannot require third parties to return, delete, or stop distributing copies of content they lawfully obtained before your revocation.
Submitting a question and participating in Ask Doctor Cliff are voluntary.
If selected, you may decline to answer a question, decline to discuss a particular subject, decline to provide documents or other information, or ask to stop the recording.
Your decision whether to participate will not affect your eligibility for or access to healthcare services from Dr. Olson, Applied Hearing Solutions, or another healthcare provider.
Ask Doctor Cliff is an educational and informational program and is not a healthcare appointment.
Participation does not establish an audiologist-patient, physician-patient, or other healthcare provider-patient relationship between you and Dr. Clifford Olson, AskDoctorCliff.com, or Applied Hearing Solutions.
Dr. Olson may discuss the circumstances you describe, explain hearing healthcare concepts, discuss hearing aids and hearing technology, explain testing or treatment approaches, and provide general educational information related to your question.
However, your Ask Doctor Cliff conversation is not an audiologic or medical evaluation, diagnosis, treatment plan, hearing aid fitting, prescription, telehealth appointment, or individualized healthcare service.
Information provided through Ask Doctor Cliff should not replace individualized evaluation or treatment by an appropriately licensed healthcare professional who can personally evaluate you.
If you voluntarily provide or display an audiogram, hearing test result, medical or audiologic document, photograph, video, screenshot, hearing aid report, device information, or other material for discussion, you authorize its display, discussion, editing, reproduction, and publication as part of your Ask Doctor Cliff participation and related content.
You represent that you have the right to provide the material and agree not to knowingly submit private or confidential information belonging to another person unless you have authority to disclose it.
You understand that participation is voluntary and that you will not receive compensation, royalties, residuals, licensing fees, or other payment for your participation or for the use of your recording, image, voice, likeness, statements, or materials unless separately agreed to in writing.
The recording and resulting Ask Doctor Cliff content will be owned by AskDoctorCliff.com and/or its producer, subject to applicable law.
You grant the rights necessary to edit, reproduce, distribute, publish, promote, and otherwise use the recording as described in these terms.
